Statement of the Protection, Confidentiality and Privacy of the Job Applicants’ Personal Data (in accordance with GDPR)

 

As part of any staff recruitment procedure, "TESY" OOD (the Company) collects and processes personal data of the job applicants. The Company undertakes to collect and use these data in a transparent manner and to comply with its obligations to protect the data.

What information do we collect?

"TESY" OOD collects a set of information about you. It includes:

·         your name, address and contact details, including e-mail address and telephone number;

·         details of the acquired qualification, skills, professional background and length of service;

·         information about your rights to work in Bulgaria;

·         video surveillance is used at the entrance and in the public spaces of "TESY" OOD, in order to ensure safe working conditions for the Company employees and to protect their legal rights and interests, as well as to provide for the necessary crime prevention; the video surveillance is always indicated by information signs in accordance with GDPR requirements.

The Company may collect this kind of information in different ways. For example, the data may be contained in the job applications, CVs or resumes, obtained from your passport or other ID documents, or collected during the interview or other form of assessment.

We may also collect your personal data from third parties, for example from former employers in relation to job references. Such information will be sought from third parties only after the job offer is presented to you, and we will, in turn, inform you of such steps taken.

The data will be kept at different places, including in the registration of your applications, in the human resource management systems and in other information systems (including e-mail).

 

Why does "TESY" OOD process personal data?

We have to process personal data, so as to be able to take the necessary steps in relation to your application, before we proceed to the signing of a contract with you. Moreover, we may have to process your personal data, in order to conclude the contract with you.

Sometimes we have to process personal data to make sure that we comply with our legal obligations. For example, before the appointment of the applicant, we are obliged to verify whether the applicant is entitled to work on the territory of Bulgaria.

The Company has a legitimate interest in processing personal data in the course of the staff recruitment procedure and to keep records of this procedure. The processing of the job applicants’ data enables us to administer the staff recruitment procedure, to assess and verify the applicants’ ability to execute the job and to make a decision as to whom should we offer the job.

If your job application is not selected, the Company may keep your personal data in a file, in case job opportunities open up in the future, for which you would be the appropriate candidate. Before we proceed to the storing of your personal data for such purposes, we will request your consent, which you can withdraw at any time.

  

Who has access to the data?

Your information may be shared internally for the purposes of the staff recruitment procedure. This includes the employees of the human resource department, the staff recruitment employees, who carry out the interviews and take part in the selection process, the managers of the departments with vacancies and the IT staff, if the access to the data is necessary for the execution of their functions.

We will not share your data with third persons, unless your job application is approved and a job offer is presented to you. In such cases, in order to obtain information about you, we may share your data with former employers and the persons, who are aware of your previous employment, so as to complete the necessary prior verifications. 

 

How does "TESY" OOD protect the data?

We deal with the security of your personal data responsibly. We have introduced internal procedures and control mechanisms ensuring that your data will not be lost, accidentally destroyed, used or disclosed improperly, and that the data are not accessible to persons, other than our employees, who need them for the proper execution of their duties.

 

How long does "TESY" OOD keep the data?

If your job application is not selected, the organization will keep your data on paper or in electronic form as a file/folder for a period of 6 (six) months after the end of the relevant selection procedure. If you give your consent to provide your personal data on paper or in electronic form as a file/folder, we will keep your data for further 6 (six) months for potential future appointment opportunities. In the end of this period or if you withdraw your consent, your data will be erased or destroyed. When you submit your CV, you will be asked whether you give your consent for the keeping of your data for the entire 12-month period, in order to be considered for other positions or not.

If your job application is selected, your personal data collected in the selection process will be transferred to your work file (in electronic or paper form) and kept for the period of your employment. You will receive a new notice of the periods, during which your data will be kept.

 

Your rights

Being a data subject, you have a set of rights. You can:

·         upon request, have access to and receive a copy of your data;

·         request the organization to rectify inaccurate or incomplete data;

·         require the organization to erase or stop processing your data, for example the data that are no longer necessary in relation to the purposes for which they are processed;

·         object to the processing of your data, where the Company refers to its legitimate interest as the legal grounds for the processing.

What happens, if you do not provide personal data?

You are not subject to a legal or contractual obligation to provide data to the Company during the selection period. However, if you do not provide information, we may not be able to process your application correctly or at all.
